What to prepare and confirm before submitting a trademark application in China.
A China trademark application is not complex — but it requires specific information and decisions to be in order before filing. Missing or incorrect information causes delays, additional fees, or suboptimal protection scope. This checklist helps foreign applicants arrive at the filing process prepared.

Work through each section of this checklist before your first meeting with a China IP agent. The better prepared you are at the outset, the smoother and faster the filing process will be. If any item reveals an open question, resolve it before proceeding — decisions made after filing are more expensive and less effective.

Can I file a China trademark application in English?
The CNIPA (China National Intellectual Property Administration) processes applications in Chinese. Your registered China IP agent will handle translation and submission. You provide the source materials in your language; your agent prepares the formal application.
Do I need to use a Chinese-character trademark to protect my brand in China?
Not required, but often advisable. Chinese consumers frequently create informal Chinese transliterations of foreign brand names — and those informal versions can be registered by third parties if the foreign brand hasn't filed them. Filing a Chinese-character version yourself is a common defensive step for brands with China market activity.
What is the risk of filing in the wrong class?
Trademark protection in China is class-specific. Filing in the wrong class means your mark is unprotected in that class, even if your registration is otherwise valid. Third parties can register your mark in unprotected classes. Your agent should help you assess full class coverage — don't optimize only for core product classes.
How do I know if my mark is already registered in China?
CNIPA maintains a public trademark search system. Your agent should run a clearance search before filing. A clean search doesn't guarantee registration, but it identifies obvious conflicts. If conflicts exist, your agent can advise on filing strategy or mark modification.
