China Trademark Filing Document Checklist

What to prepare and confirm before submitting a trademark application in China.

A China trademark application is not complex — but it requires specific information and decisions to be in order before filing. Missing or incorrect information causes delays, additional fees, or suboptimal protection scope. This checklist helps foreign applicants arrive at the filing process prepared.

Before You Begin

Work through each section of this checklist before your first meeting with a China IP agent. The better prepared you are at the outset, the smoother and faster the filing process will be. If any item reveals an open question, resolve it before proceeding — decisions made after filing are more expensive and less effective.

Applicant Information

Full legal name of the applicant (individual or company name exactly as registered)
Applicant nationality or country of incorporation
Address of the applicant in full (for foreign applicants: foreign address is fine)
Legal representative name (for companies) or ID information (for individuals)
Contact information for the filing agent to reach the applicant if needed

Mark Materials

Finalized, high-resolution version of the trademark mark (wordmark or logo)
Confirmed decision on wordmark-only vs. design + wordmark application strategy
If a Chinese-character version is being filed: confirmed character selection and meaning review
Color specification: confirm whether mark will be filed in black & white (broader coverage) or in color
If a device mark: confirm no elements that could create distinctiveness issues in CNIPA practice

Class Selection and Goods/Services Description

Primary Nice Classification class(es) identified for the core product or service
Confirmed class coverage for distribution channels (retail, e-commerce, third-party resale)
Confirmed class coverage for related services (after-sale service, technical support, etc.)
Goods/services description reviewed for compliance with CNIPA acceptable descriptions list
Decision made on whether to file in one application per class or multi-class strategy

Agent Engagement and Authorization

A qualified China IP agent has been identified and engaged
Power of attorney (委托书) prepared or requested from agent — required for foreign applicant filings
Agent has confirmed filing fees for each class and application type
Agent has confirmed timeline estimate and examination procedures for this filing
Applicant has confirmed understanding of the 12–18 month examination period and opposition window

Frequently Asked Questions

Can I file a China trademark application in English?

The CNIPA (China National Intellectual Property Administration) processes applications in Chinese. Your registered China IP agent will handle translation and submission. You provide the source materials in your language; your agent prepares the formal application.

Do I need to use a Chinese-character trademark to protect my brand in China?

Not required, but often advisable. Chinese consumers frequently create informal Chinese transliterations of foreign brand names — and those informal versions can be registered by third parties if the foreign brand hasn't filed them. Filing a Chinese-character version yourself is a common defensive step for brands with China market activity.

What is the risk of filing in the wrong class?

Trademark protection in China is class-specific. Filing in the wrong class means your mark is unprotected in that class, even if your registration is otherwise valid. Third parties can register your mark in unprotected classes. Your agent should help you assess full class coverage — don't optimize only for core product classes.

How do I know if my mark is already registered in China?

CNIPA maintains a public trademark search system. Your agent should run a clearance search before filing. A clean search doesn't guarantee registration, but it identifies obvious conflicts. If conflicts exist, your agent can advise on filing strategy or mark modification.
